Terms of Service

Agreement and eligibility

By submitting a request, placing an order, or using the service, you agree to these Terms. You must be at least 18 and have authority to act for the person, owner, brokerage, or business you represent.

Services

Your Home Sites creates and hosts property-marketing websites using information and media you provide and, when appropriate, public or third-party information. MAAE Media provides design, marketing, and website services only. We are not a brokerage, MLS, appraiser, inspector, attorney, insurer, title company, or provider of legal or financial advice.

Order acceptance and scope

A submitted request is not a guarantee that we will accept every project. A project is accepted when we confirm it or begin work. Pricing, scope, hosting period, turnaround, and included revisions are those shown when ordering or confirmed in writing. Turnaround begins once we have the complete information and complete media package needed for production. Staggered or incomplete materials can delay delivery.

Customer responsibilities

You are responsible for accurate information; reviewing and approving facts before publication; complying with brokerage, MLS, advertising, fair-housing, and other applicable requirements; keeping shared links accessible; and promptly communicating corrections. Public-record and third-party information can be incomplete or inaccurate and must be reviewed by you.

Rights to submitted content

You represent that you own or have sufficient permission to provide and authorize use of all submitted materials. You grant MAAE Media a non-exclusive, worldwide, royalty-free license to copy, edit, resize, format, host, display, transmit, and otherwise use those materials as reasonably necessary to create, operate, maintain, support, and archive the requested Home Site. You retain ownership of customer-supplied materials.

Platform intellectual property

MAAE Media retains ownership of the platform, templates, source code, reusable layouts, design systems, workflows, tools, and other pre-existing or reusable materials. Unless agreed otherwise in writing, you receive the right to use the completed Home Site for its property-marketing purpose and hosting period. The underlying platform, templates, and code are not transferred.

Public nature of listings

A completed Home Site is intended to be public. Its address, media, property information, branding, and contact information may be viewed, shared, indexed, cached, or copied by third parties. Do not submit material for publication that should remain confidential.

Third-party services

The service may depend on third-party hosting, storage, maps, email, payment, analytics, domain, public-data, Google Drive, Dropbox, or similar services. Their availability and terms are outside our control. We may change providers as needed to operate the service.

Fees, cancellations, and refunds

All fees paid for Your Home Sites services are non-refundable, except for a verified billing or payment error, such as a duplicate payment or overpayment, or where a refund is otherwise required by applicable law.

Because each Home Site is custom creative and production work, no refund is provided because a listing is withdrawn, a property sells before the Home Site is completed, you change your mind, submitted information or media is delayed or incomplete, you stop responding, or you ultimately choose not to use the completed Home Site.

If there is a problem with the service or deliverables, MAAE Media will work in good faith to correct the issue and provide the deliverables included in the agreed scope. Correction, revision, or completion of the agreed work is the service-related remedy rather than a refund.

Verified duplicate charges, overpayments, or other payment-processing errors will be corrected or refunded as appropriate. Unpaid balances may pause production or cause a site to be unpublished.

Revisions, delivery, and hosting

Included revisions and hosting are those stated with the order or written confirmation. Material scope changes, replacement media after production begins, or requests beyond scope may require additional time or fees. We may suspend or remove a site when reasonably necessary for security, nonpayment, suspected infringement, unlawful content, abuse, or a provider requirement.

No results guarantee

We do not guarantee a sale, showing, lead, search ranking, traffic level, marketing result, or uninterrupted or error-free availability.

Warranty disclaimer

To the maximum extent permitted by law, the service is provided on an “as available” basis and without warranties beyond express written commitments for a specific order.

Liability limits

To the maximum extent permitted by law, MAAE Media is not liable for indirect, incidental, special, consequential, exemplary, lost-profit, or lost-opportunity damages. For a claim relating to an order, aggregate liability will not exceed the amount paid to MAAE Media for that order, except where law does not allow that limit.

Indemnity

You agree to defend, indemnify, and hold MAAE Media harmless from third-party claims, losses, liabilities, and reasonable costs arising from materials or information you supply, alleged infringement or lack of permission, your violation of law or industry rules, or your misuse of the service.

Copyright complaints

If you believe content on a Home Site infringes your copyright, please follow the complaint procedure on our Copyright & DMCA page.

Governing law and venue

Texas law governs these Terms, without regard to conflict-of-law rules. Unless applicable law requires otherwise, disputes will be brought in the state or federal courts located in Collin County, Texas.

Changes

We may update these Terms. The version applicable to an order is the version accepted when submitted unless you later affirmatively accept a newer version.
